Watch24Online recommends you to read these Terms and Conditions carefully before using our website, services or Goods. These Terms and Conditions are a legally binding Contract between you (the buyer) and Watch24Online. By using these services, you agree to the following Terms and Conditions, Services, Domestic and International shipping terms, Return and Privacy Policy. 1. APPLICATION AND ENTIRE AGREEMENT
1.1 These Terms and Conditions will apply to the purchase of Goods detailed in our quotation by the customer (you) from Watch24Online.
1.2 These are the terms on which we sell all Goods to you. By Ordering any of the Goods, you agree to the bound by these Terms and Conditions. You can only purchase the Goods from the website if you are eligible to enter into a Contract and are at least 18 years old.
1.1 These Terms and Conditions and the quotation (together, the Contract) apply to the purchase and sale of any Goods between us and you, to the exclusion of any other terms that you try to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.
1.2 These Terms and Conditions supersede any previous general Terms and Conditions by Watch24Online.
2. INTERPRETATION
2.1 Consumer means an individual acting for purpose which are wholly or mainly outside his or her trade, business, craft or profession;
2.2 Contract means the legally-binding Agreement between you and us for the supply of the Goods;
2.3 Terms and Conditions means the Terms and Conditions stated by Watch24Online;
2.4 Agreement means any Agreement between Watch24Online and the buyer;
2.5 Goods means all Goods Watch24Onlie offers and/or sells through the (brand) name Watch24Online;
2.6 Order means the customer’s Order for the Goods from Watch24Online as submitted following the step by step process set out on the website;
2.7 A Business Day means any day other than a Saturday, Sunday or any other public holiday.
3. GOODS
3.1 The description of the Goods set out in our webshop, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size, state and color of the Goods.
3.2 Details of the Goods as described in the description of the Goods are subject to alteration without notice and are not a Contractual offer to sell the Goods, which is capable of acceptance.
3.3 We can make changes to the price or description of the Goods at any time.
3.4 All sell prices and purchase offers are subject to change in market conditions.
3.5 All Goods that appear on the website are subject to availability. If a good is out of stock (sold) despite appearing available in the webshop, Watch24Onlie has the right to cancel the buyer’s Order.
3.6 When placing an Order, the buyer promises that all details provided are true and correct, and that you are authorized user to commit any payment.
4. PERSONAL INFORMATION
4.1 We retain and use all information strictly under the Privacy Policy.
4.2 We may contact you by using e-mail or other electronic communication methods and by pre-paid post and you expressly agree to this.
5. BASIS OF SALE
5.1 The description of the Goods in our website does not constitute a contractual offer to sell the Goods. When an Order has been submitted on the website, we can reject it for any reason, although we will try to tell you the reason.
5.2 The Order process is set out on the website. Each step allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly.
5.3 A Contract will be formed for the sale of Goods ordered only when you receive an email from us confirming the Order (Order confirmation). You must ensure that the Order confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order, you agree to us giving you confirmation of the Contract by means of an email with all information in it.
5.4 Any quotation is valid for a maximum of 3 days from its date, unless we expressly withdraw it at an earlier time.
5.5 No variation of the Contract, whether about description of the Goods, fees or otherwise, can be made after it has been entered into unless the Customer and we agree the variation in writing.
6. PRICE AND PAYMENT
6.1 The price of the Goods and any additional and any additional delivery or other charges is that set out on the website at the date of the Order or such other price as we may agree in writing.
6.2 Prices and charges included VAT at the rate applicable at the time of the Order.
6.3 We do not accept any other method of payment than the payment methods mentioned on the website. Payment methods may change at any time. All costs of payment will be passed on to the Consumer.
7. DELIVERY
7.1 All Goods Ordered by the Consumer will be shipped within 1 Business Day after the confirmation of the Order.
7.2 The Goods ship to the shipping address provided by the Consumer on the website.
7.3 Instead of having the Goods shipped, the Consumer can decide to pick up the Goods at our location in Goor. The Consumer should always indicate this option correctly when placing an Order on our website.
7.4 Import and export duties, as well as all other levies or taxes imposed or levied in respect of the Goods, the shipping and customs clearance shall be the Consumer’s expense.
7.5 All national and international shipping services used by Watch24Online provide with a tracking number.
7.6 The Goods will become the Consumer’s responsibility from the completion of delivery or customer’s collection. You Consumer must, if reasonably practicable, examine the Goods before accepting them.
8. RISK AND TITLE
8.1 Risk of damage to, or loss of, any Goods will pass to you when the Goods are delivered to you.
8.2 You do not own the Goods until we have received payment in full. If full payment is overdue or a step occurs towards your bankruptcy, we can choose, by notice to cancel any delivery and end any right to use the Goods still owned by you, in which case you must return them or allow us to collect them.
9. WITHDRAWAL AND CANCELLATION
9.1 You can withdraw the Order by telling us before the Contract is made, if you simply wish to change your mind and without giving us a reason, and without incurring any liability.
9.2 Online purchases can be cancelled by telling us no later than 5 calender days from the day the Contract was entered into, if you simply wish to change your mind and without giving us any reason, and without liabitility, except in the case, you must return to any of our business premises the Goods in undamaged condition.
9.3 Subject as stated in these Terms and Conditions, you can cancel your online purchase within 5 days. Purchases made by appointment or pick up are always final.
9.4 The cancellation period for online purchases through www.watch24online.nl will expire after 5 days from the day on which you acquired the Goods.
9.5 To exercise the right to cancel, you must inform us of your decision to cancel this Contract by a clear statement setting out your decision.
9.6 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired. See return policy
9.7 Goods must return with all delivered accessoiries and in complete and original state and, to the extent possible, in tits original packaging.
9.8 We may make a deduction from the reimbursement for loss in value of any Goods supplied, if the loss is the result of unnecessary handling by you. This is because you are liable for that loss and, if that deduction is not made, you must pay us the amount of that loss.
10. RETURNING GOODS
10.1 If you have received Goods in connection with the Contract, which you have cancelled, you must get in contacted with us by email or phone immediately and in any event not later than 5 days from the day on which you communicate to us your cancellation of this Contract. The deadline is met if you send back the Goods before the period of 14 days has expired. You agree that you will have to bear the cost of returning the Goods.
11. CONFORMITY AND GUARANTEE
11.1 We have a legal duty to supply the Goods in conformity with the Contract, and will not have conformed if it does not meet the following obligation.
11.2 Upon delivery, the Goods will be of satisfactory quality and confirm the description.
11.3 It is not a failure to conform if the failure was mentioned in any description related to the Goods.
12. LIABILITY AND SUB-CONTRACTORS
12.1 We will in no event be liable to the Consumer for any indirect loss or damage arising out of or in connection with the Contract, the sale of any Goods by us or the use of the customer, whether or not such damage is based on tort, product liability, guarantee or otherwise, unless the damage is caused by intent or willful by us.
12.2 The Consumer can transfer or sell the Goods to someone else. Watch24Online will not be liable for the acts of any sub-contractors or consumers in any way. The initial Contract will immediately end when the Consumer sells the Goods to any third party.
13. GOVERNING LAW AND JURISDICTION
13.1 These Terms and Conditions, Privacy Policy and Contract (including any non-contractual matters) are governed by the laws of the Netherlands.
13.2 Disputes can be sumitted to the jurisdiction of the courts of the Netherlands.
13.3 To avoid any dispute, we deal with complaints in the following way; If a dispute occurs customers should contact us to find a solution. We will aim to respond with an appropriate solution within 5 days.
